1.The agreement
These terms are an agreement between you and InfluenceStats (“we”, “us”). They cover influencestats.io, the InfluenceStats app and any related services (the “service”).
By creating an account or using the service, you accept these terms and our privacy policy. If you use the service for an organisation, you confirm you’re allowed to accept these terms for it, and “you” includes that organisation.
2.Who can use InfluenceStats
- You must be at least 18 years old.
- You can use the service for your business or for yourself. Some parts of these terms apply differently to consumers, meaning people using it outside their trade, business or profession; where they do, we say so.
- You must give accurate details when you sign up and keep them up to date.
- You can’t use the service if we’ve previously closed your account for breaking these terms.
3.Accounts and workspaces
- Your account belongs to you personally. Keep your password safe and tell us straight away if you think someone else has used it.
- Work happens in workspaces. The owner of a workspace controls its plan, billing and members, and is responsible for what members do in it.
- Owners and admins can invite people as admins, analysts or viewers. Anyone with access to a workspace can see the data in it.
- One person can own up to 5 workspaces. Free sign-up credits are given once per person, on their first workspace. Creating extra accounts to collect more free credits isn’t allowed.
4.What the service does
InfluenceStats analyses publicly available Instagram profiles and posts: follower counts, engagement, content, public comments and similar signals. It lets you track changes over time, organise creators into lists and campaigns, generate AI insights, export reports and share read-only links.
- We’re not affiliated with Instagram or Meta. Data is collected from public sources through third-party providers. We can’t guarantee that any particular profile or post can be fetched, or that it will stay available.
- Numbers can be wrong or out of date. Public data changes constantly and sources can make mistakes. Reports show when their data was captured.
- Scores and insights are signals, not verdicts. The audience quality score is a heuristic based on a sample of commenters. AI insights are written by a language model from the report data and can contain errors. Check anything important before you rely on it.
- The service doesn’t give legal, financial or professional advice. You decide who to work with and on what terms.
5.Credits
Some actions use credits, because they cost us money to run. Current prices are shown in the app and on our pricing page.
- Credits are reserved when you start an action and only charged when it succeeds. If it fails, the credits go back to your balance automatically.
- Credits that come with a subscription expire the day after the billing period they belong to ends. Sign-up credits and credits you buy in packs don’t expire while your account is open.
- When you spend credits, the ones that expire soonest are used first, and bought credits last.
- Credits belong to a workspace. They have no cash value, can’t be exchanged for money, transferred or sold, and are lost when the workspace is deleted.
- We may change how many credits an action costs. Changes apply to actions started after the change, never to credits you already hold.
6.Plans, payment and cancelling
- Payments are handled by Dodo Payments, which acts as the merchant of record: it processes your payment, issues invoices and collects any sales tax or VAT. Its own terms also apply to the purchase.
- Paid plans renew automatically at the end of each monthly or yearly period until you cancel.
- You can cancel at any time from the billing settings. Your plan stays active until the end of the period you’ve paid for, then the workspace returns to the Free plan.
- Switching between paid plans takes effect straight away, and the price difference is prorated.
- If a payment fails, we’ll email the workspace owners and admins. If it isn’t resolved, the subscription may be paused or cancelled.
- We may change plan prices. We’ll tell you at least 30 days before a change affects your subscription, and it applies from your next renewal. You can cancel before then.
Refunds are covered by our refund policy.
7.Acceptable use
You’re responsible for how you use the service and the data it gives you. You agree not to:
- use it to stalk, harass, intimidate, dox or discriminate against anyone, or to target children;
- try to infer or process sensitive information about people, such as health, religion, sexual orientation, political opinions or ethnic origin;
- use data from the service to send unsolicited messages or spam, or in any way that breaks data protection, privacy, consumer or marketing laws;
- resell, publish or redistribute data from the service in bulk, or build a competing database or product from it;
- scrape, crawl or automate the app, work around credit charges, rate limits or plan limits, or access it other than through the interfaces we provide;
- probe, attack or disrupt the service, or try to access other people’s accounts or workspaces;
- upload anything unlawful, or content you don’t have the right to use.
When you use personal data from the service, such as a creator’s profile, you are responsible for having a lawful reason to do so and for meeting your own obligations under data protection law.
8.Your content and share links
- Notes, briefs, lists, campaigns, comments and other things you add stay yours. You give us permission to store, process and display them only so we can run the service for you.
- Anyone with a share link can see what it shares, without an account, until the link expires or you turn it off. Only share links with people you trust, and choose carefully what to include.
- Where we process personal data in your workspace on your behalf, we act as your processor. If you need a data processing agreement, email us.
9.Our intellectual property
The service, its software, design, reports and brand belong to us or our licensors. We give you a limited, non-exclusive, non-transferable right to use it under these terms. Reports and exports you create can be used for your own business purposes, including sharing them with your clients. Feedback you send us can be used without any obligation to you.
10.Availability and changes
We work to keep the service running and your data safe, but we don’t promise it will always be available or free of errors. We may add, change or remove features. If we remove something significant from a paid plan, we’ll tell you in advance, and you can cancel. Third-party services we rely on, including Instagram and our data providers, can change or stop without notice, which may affect what the service can do.
11.Suspension and closing accounts
- You can delete your account at any time in the app under Settings → Account. Workspaces you own alone are deleted with it, including their credits, analyses and reports. Workspaces with other members pass to the most senior remaining member. Cancel any subscription first.
- We may suspend or close an account, or remove content, if you break these terms, don’t pay, create risk or legal exposure for us or others, or if the law requires it. Where it’s reasonable, we’ll warn you first and give you a chance to fix the problem.
- If we close your account for breaking these terms, you’re not entitled to a refund of fees or credits.
- If we stop offering the service altogether, we’ll give you at least 30 days’ notice and refund any prepaid subscription for the time after it ends.
12.Disclaimers and liability
The service is provided “as is” and “as available”. To the extent the law allows, we make no promises about it beyond those in these terms, including about accuracy, fitness for a particular purpose or the results of any campaign.
To the extent the law allows, we’re not liable for indirect or consequential losses, lost profits, revenue, business or goodwill, or for decisions you make based on data or insights from the service. Our total liability for all claims relating to the service is limited to the amount you paid us in the 12 months before the claim arose, or €100 if that’s more.
Nothing in these terms limits liability that can’t be limited by law, such as for fraud, gross negligence, or death or personal injury caused by negligence. If you’re a consumer, nothing in these terms takes away the rights consumer law gives you, including your rights if the service isn’t as described or not provided with reasonable care and skill.
You agree to cover our reasonable costs from claims by others that arise from your breach of these terms or your unlawful use of data from the service.
13.Changes to these terms
We may update these terms. For significant changes we’ll email account owners or show a notice in the app at least 30 days before they take effect. If you keep using the service after that, the new terms apply. If you don’t agree, you can cancel and delete your account before then.
14.Law and disputes
These terms are governed by the laws of the country where InfluenceStats is established, and its courts decide any dispute. If you’re a consumer, you also keep the protection of the mandatory laws of the country where you live, and can bring a claim there.
Before going to court, please email us so we can try to sort it out. If any part of these terms can’t be enforced, the rest still applies. Not enforcing a term straight away doesn’t mean we give up the right to.
